1. They are heard. Perused the case diary / challan papers.

2. This is first bail application filed by the applicant under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 (439 of Cr.P.C.) as he/she is implicated in connection with Crime No.19/2026 registered at Police Station Sonkatch, District Dewas (MP) for offence punishable under Section 34(2) of the Madhya Pradesh Excise Act, 1915. The applicant is in custody since 08/01/2026.

3. As per prosecution story, the applicant along with co-accused Vijay was found in possession of 54 bulk littres of unauthorized liquor.

4. Counsel for the applicant has submitted that the present application has been filed on the ground of applicant's marriage, which is to take place on 23/01/2026. It is submitted that this is the applicant's first offence and if he is not released on bail, he would suffer severe blow as his marriage would be jeopardized. Hence, it is prayed that the application be allowed and the applicant be released on bail.

5. Counsel for the respondent / State, on the other hand has opposed the prayer, however, it is not denied that the applicant has no criminal antecedents.

6. Having considered the rival submissions and perusal of the case diary as also the documents filed on record, taking note of the fact that this is applicant's first offence and he is also due to marry on 23/01/2026, this Court is inclined to allow the present application with an observation that this Court might not be so lenient if the applicant is again arrested in connection with any other offence.

7. The applicant is directed to be released on bail upon furnishing a personal bond in the sum of Rs.25,000/- (rupees twenty five thousand) with one solvent surety of the like amount to the satisfaction of the trial Court for his/her regular appearance before the trial Court during trial with a condition that he / she shall remain present before the court concerned during trial and shall also abide by the conditions enumerated under Section 437 (3) Criminal Procedure Code, 1973.

8. M.Cr.C. stands allowed.
