Civil Writ Petition No. 24100 of 2011

3. Reply filed on behalf of respondent No. 5 today in Court is taken on record.

4. This writ petition has been filed in public interest seeking directions to respondents No. 1 to 3 to conduct an inquiry/investigation into the

reckless issuance of mobile phone connections on the basis of fake identity proofs/documents by respondents No. 4 and 5. To show that the

above act has been done, reference was made to the issuance of 59 pre-paid mobile phone connections, details of which are given at page Nos. 4

and 5 of the writ petition. Perusal thereof indicates that in the name of four or five individuals, 20 mobile phone connections have been issued. A

further prayer has been made that directions be issued to respondents No. 1 and 2 to introduce effective safeguards for preventing the issuance of

multiple mobile connections.

5. At the time of arguments, it was brought to our notice that the directions for issuance of mobile phone connections in future have already been

issued by Hon''ble the Supreme Court in Avishek Goenka v. Union of India and Others (Writ Petition (Civil) No. 265 of 2011, decided on

27.4.2012). So far as inquiry regarding issuance of mobile phone connections on the basis of fake identity proofs/documents is concerned it is

stated by respondents No. 4 and 5 that they have already made a complaint (Annexure R4/1) against their franchise namely M/s Goel

Communications, Refinery Road, Rama Mandi, to the Senior Superintendent of Police, Bathinda who has marked the same to the Station House

Officer, Police Station Kotwali for further action and investigation.

6. Under the circumstances, we dispose of this writ petition by issuing directions to the Senior Superintendent of Police, Bathinda, to get an inquiry

conducted through a senior police officer regarding issuance of multiple mobile phone connections against fake identities/documents. At the time of

investigation, connivance of respondents No. 4 and 5, if any, be also looked into. The investigation be concluded within three months from the date

of receipt of this order. A copy of this order be sent to the Senior Superintendent of Police, Bathinda, for strict compliance.
