Pritam Pal, J.@mdashThis is a petition filed by the Petitioner for grant of regular bail u/s 439 of the Code of Criminal Procedure, in a case bearing FIR No. 117 dated 06.11.2006, under Sections 498-A/ 304-B/34 of IPC, registered at Police Station, Mohana.

2. Learned Counsel for the Petitioner contends that there are general allegations against all the accused in this case and husband of the deceased has already been granted bail by this Court vide order dated 12.1.2007. The Petitioner is un-married brother-in-law of the deceased. He is, in fact, a psychiatric patient. In this regard, counsel for the Petitioner has made a reference to certificate Annexure P-1, issued by the doctor of P.G.I, Rohtak. This contention of counsel for the Petitioner is not rebutted by learned State Counsel. The Petitioner is in custody since 8.11.2006.

3. Without commenting any further on the merit of this case, the Petitioner is ordered to be released on bail on his furnishing bail bond/surety to the satisfaction of the trial Court.

4. This Criminal Misc. is allowed.
