Alok Singh, J.@mdashThis is a petition seeking anticipatory bail in case FIR No. 31 dated 26.01.2008, under Sections 304-A/279/427 IPC,

registered at Police Station City Tarn Taran, Punjab.

2. Learned Counsel for the Petitioner states that Petitioner was on regular bail in case FIR No. 31 dated 26.01.2008, under Sections 304-

A/279/427 IPC, Police Station City Tarn Taran, however, on 26.01.2009, Petitioner could not appear before the Court, hence, non-bail able

warrants were issued against the Petitioner. Learned Counsel further states that since Petitioner remained ill, therefore, he could not appear before

the Court on 26.01.2009. There is no satisfactory explanation given as to why Petitioner did not appear on any date after 26.01.2009.

3. Since, there is no satisfactory explanation as to why Petitioner did not appear for more than 2 years after 26.01.2009, I am not inclined to grant

anticipatory bail to the Petitioner.

4. Petition is dismissed. However, it is directed that if Petitioner appears/surrenders before the Court within 10 days from today and moves regular

bail application, the same shall be decided, at its own merit, in accordance with law, without any undue delay.
