Rakesh Kumar Jain, J.@mdashThis revision petition has been filed against the order dated 17.01.2011 (Annexure P-5) vide which the application filed by the tenant to amend the written statement has been declined on the ground that it is to delay the proceedings.

2. Counsel for the Petitioner has submitted that in the absence of pleadings, he would not be able to lead evidence and precisely on that ground he sought the amendment.

3. At this stage, counsel for the Respondent has submitted that they would not raise any objection before Rent Controller in case the tenant leads evidence, for which the permission has already been granted by the learned Rent Controller, despite the fact that they have not pleaded the said fact.

4. This concession made by learned Counsel for the Respondent satisfies the counsel for the Petitioner.

5. In view thereof, this revision petition is accordingly disposed of.
