Rakesh Kumar Garg, J.@mdashApplicant Jagir Singh has filed the instant application for impleading him as a party - Appellant in RFA No. 1039 of 2005 submitting that his land was also acquired along with co-owners and reference u/s 18 of the Land Acquisition Act, 1894 was sent to the Reference Court. However, his name was not mentioned and, therefore, he could not be represented before the Reference Court and his name has also not appeared in the award dated 22.12.2004 passed by Additional District Judge, Panchkula u/s 18 of the Act.

2. Admittedly, the applicant has not been shown to be a party before the Reference Court and, therefore, he cannot be impleaded in the present appeal.

3. Faced with this situation, counsel for the applicant seeks time to withdraw the present petition with liberty to pursue his application filed before the Reference Court.

4. With the aforesaid liberty, this application is dismissed.
