Jaya Roy, J.@mdashHeard counsel appearing for the petitioner and counsel appearing for the State. Counsel appearing for the petitioner has
submitted that though the case has been registered under Sections 458/449/341/323/307/376/511/504 of the Indian Penal Code and Section 27
of the Arms Act but charge-sheet has been submitted only under Sections 458/450/341/323/307/354/504 of the Indian Penal Code even injury
report of the husband of the informant shows that he has received simple injuries on his finger of the right hand. It is further submitted that the
petitioner is in custody since 2nd February, 2013 i.e. more than five months.
2. Counsel appearing for the State has opposed but not disputed the aforesaid contentions made by the counsel for the petitioner.
Considering the submissions made by both the parties and considering the period of custody of the petitioner, the petitioner, above named, is
directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of
Shri Dhananjay Kumar, Judicial Magistrate, 1st Class, Godda in connection with Poraiyahat P.S. Case No. 16 of 2013 corresponding to G.R.
No. 123 of 2013 subject to the condition that one of the bailors will be local resident having immovable property within the jurisdiction of district
concerned.
