R.R. Prasad, J.@mdashHeard learned Counsel appearing for the petitioners and learned Counsel appearing for the State.

2. Learned Counsel appearing for the petitioners submits that admittedly these petitioners were senior to Md. Fidaur Rahman and Raj Kumar Prasad, as per the seniority list prepared for the District of Dhanbad in the year 1987 but Graduate Science Trained (Grade IV) pay scale was not given to these petitioners in spite of the fact that petitioner No. 1 had completed training on 13.5.2005, petitioner No. 2 had completed training on 29.4.1987 whereas petitioner No. 3 had completed training on 11.3.1987, rather junior to the petitioners'' namely Md. Fidaur Rahman and Raj Kumar Prasad were given the said scale.

3. Learned Counsel appearing for the petitioners further submits that when this discrepancy came to the knowledge of District Superintendent of Education. Dhanbad, he noted it down in his order, as contained in memo No. 1609 dated 18.8.2006 and made recommendation before the District Establishment Committee for granting the said scale to these petitioners but no decision has been taken by the District Establishment Committee in spite of passing of two years.

4. In view of the admitted position, this writ application is disposed of with a direction to the respondent No. 2 to convene a meeting of District Establishment Committee for taking decision of granting pay scale to these petitioners within a period of two months.

With the aforesaid direction/observation, this writ application is disposed of.
