The petitioner has prayed for issuance of direction commanding upon the respondents to pay the benefit of pension and family pension treating the petitioner as the Government employee as also certain arrears of dues which is lying with the society under whom he has performed his duty to the post of Paid Manager. The issue to the effect that as to whether the Paid Managers are not the State Government employee has already been decided that the Paid Manager are not the State Government employee. Since the petitioners except petitioner No. 1 who are admittedly working as Paid Manager under the co-operative society, are not the Government employees, which has already been decided by this Court in the case of 484
5. In view of the matter, the petitioners are not entitled to get the benefit of pension and family pension. Hence, the prayer with respect to payment of pension and family pension is hereby not fit to be entertained, as such the writ petition regarding the same is hereby rejected.
6. However, the petitioners are at liberty to approach to the competent authority to make appropriate representation before the Member Secretary, Managing Director, District Co-operative Cadre Society, West Singhbhum (Respondent No. 3) who will look into the matter and do needful and if any amount is lying due with the respondent authorities, the same may be released in favour of the petitioners without any delay. The writ petition stands disposed of, accordingly.
