1. Petitioner is challenging the legality and correctness of non-granting the interim order of stay by the Karnataka Administrative Tribunal on his Application No. 6901/2011 dated 17.10.2011.

2. Petitioner was deputed to State Accounts Department and he worked as Second Division Assistant from 1996 end thereafter in December 2005, he has been promoted as First Division Assistant and WAS continued to work in the same department By order defied 21.9.2011, he has been repatriated to the parent department The said order was questioned by the petitioner before the Karnataka Administrative Tribunal and requested the Karnataka Adminstrative Tribunal to grant an order of Interim stay. The Tribunal has declined to grant the interim order. Challenging the some, the present petition is filed.

3. We have heard the learned counsel for the petitioner.

4. When the parent department has withdrawn the service of the petitioner from karnataka Neeravari Nigama Limited, if the Tribunal exercising its jurisdiction has declined to grant an order of stay based on the facts and circumstances of the case, we cannot lightly interfere with the order of Karnataka Administrative Tribunal.

5. Accordingly, the writ petition is dismissed.
