S. Siri Jagan, J.@mdashThe Petitioner is a Law graduate, who got appointment as a Lower Division Clerk in Vatakara Municipality. As per
Ext.P3, the Kerala Municipal Common Service (Ministerial and Revenue Branch) Qualification and method of appointment Rules, 2001, the post
of Lower Division Clerk is category No. 8 and the post of Legal Assistant is category No. 7. As per the rules, the method of appointment to
category No. 7 is by transfer from category No. 8.
The Petitioner submits that the Petitioner has the qualification prescribed for the post of Legal Assistant, which is category No. 7 and therefore the
Petitioner is entitled to be considered for promotion to that post. Seeking this relief, the Petitioner has filed Ext.P4 representation before the second
Respondent. The Petitioner seeks a direction to the second Respondent to consider and pass orders on Ext.P4 expeditiously.
2. I have heard the learned Government Pleader also. In the facts and circumstances of the case, I dispose of this W.P.(C) No. 35905/10 2 writ
petition with a direction to the second Respondent to consider and pass orders on Ext.P4 as expeditiously as possible, at any rate, within two
months from the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the Petitioner.
